Photobooth Terms and Conditions

TERMS AND CONDITIONS OF CONTRACT

FOR PHOTOBOOTH HIRE

This written contract sets out the full, intentions of the parties and supersedes any previous oral agreements made between the parties.

In the following conditions of contract the supplier shall mean Amore Photography, its affiliated companies, Affiliated Persons or any person appointed by Amore Photography “The Clients” shall be those whose accept / purpose / book the photobooth hire. If the clients arrange for a third party to meet the costs of this contract the contract remains with the clients. The due performance of the contract is subject to the conditions below and cannot be varied in any way by the clients unless expressly agreed by the Amore Photography in writing.

1. Service Period

The Supplier agrees to provide a Photo Booth operational and available for use for a minimum of 80% of the agreed service period, downtime is required to permit maintenance of the Photo Booth should any be necessary arise.

2. Payment

A non -returnable booking fee of £50.00 deductible from the rental charge is required to secure a reservation for the Photo Booth, the balance of the agreed rental charge is due 6 weeks days before the Customer’s event, unless previously agreed in writing. If the operator uses the equipment for a period in excess of the agreed service period additional rental charges will be payable by the Customer to the Supplier, calculated on a pro rata basis. Payment of all additional rental charges must be made by the Customer before any additional service period commences.

3. Access, space & power requirements

The Customer will arrange for an appropriate space to be made available for the Photo Booth at the event venue. A minimum floor area of 3m x 3m is required for best operation. The Customer will provide a mains electricity supply within the space designated by the Customer for the Photo Booth

4. Date changes & cancellations

Any change of date is subject to the availability of the Photo Booth and is at the discretion of Amore Photography. Any request to alter the agreed date must be made in writing and at least 3 months prior to the Customer’s event unless otherwise agreed in writing. If the Customer cancels an agreed rental of a Photo Booth up to 6 weeks prior the rental date the deposit will be forfeit. If the Customer cancels an agreed rental of the Photo Booth within 6 weeks of the rental date the full amount of rental hire will be playable.

Cancellations are subbject to the following :

a) In the event of cancellation by the Supplier or in the highly unlikely event of operational failure, the photographer’s liability shall be limited to a full refund of any fees paid. The supplierwill not be responsible for any further costs.

b) The supplier will endeavor to contact other suppliers in the unlikely event that he is unable to attend your booking. However it may prove difficult or impossible to find a skilled replacement photographer at short notice or at the same price.

c) If the Clients should have to cancel a booking the following cancellation fees will become due immediately:

1.The Clients are entitled to a full refund of the £50 booking fee if they withdraw within 14 days of booking.

2.The booking fee of £50 will be forfeited on cancellations made after 14 days, up until 7 weeks prior to the event

3.Cancellations made within 6 weeks of the event incur the full cost of the service service booked, including optional additional attendance. 

4.In the event of postponement, then at the discretion of Amore Photography,  and subject to availability, monies other than the booking fee may be applied to the new event.

5. Loss or damage to Suppliers equipment

The Customer assumes complete responsibility for any loss of or damage to the Supplier’s equipment (other than fair wear and tear) caused by any misuse of the equipment by the Customer, their employees or their guests . The Customer shall be responsible for any loss of or damage to the Supplier’s equipment caused by Theft , Fire, Flood or Accidental Damage.

6. Indemnification

The Customer agrees to, and understands the following:

  1. a) The Customer will indemnify the Supplier against any and all liability related to the Customer’s Event and use of the Supplier’s equipment .

  2. b) The Customer will indemnify the Supplier against any and all liability associated with the use of any pictures taken at the Customer’s event by the Photo Booth or by its operatives , employees or affiliates .

The Customer agrees to, and understands the following:

(A) All persons using the Photo Booth at the Customer’s Event hereby give to Amore Photography the right and permission to copyright and to reproduce or otherwise use any photographic portraits or pictures of any Photo Booth user who may be included in whole or in part, via any or all media now or hereafter known for illustration, art, promotion, advertising, trade, or for any other purpose.

(B) In addition the Customer , hereby releases, discharges and agrees to maintain Amore Photographyfree from any liability arising out of the taking of said picture or any subsequent processing or publication thereof including, without limitation, any claims for libel or invasion of privacy.

7. Miscellaneous terms

Digital copies of the images taken on the date of your event will be stored on our system for a maximum of 6 months. You have the opportunity within this timeframe to request the digital copies at an additional charge. After these 6 months, all digital copies will be deleted and destroyed. This is not subject to any images posted on social media previously.
